1. Service
500files ("the service") is a free file-request and file-collection tool operated by Alex Kay ("the operator") at 500files.com.
2. No warranty
The service is provided "as is" and "as available", without warranty of any kind. The operator does not guarantee uninterrupted operation, error-free behavior or the preservation of files beyond their stated expiry.
3. Acceptable use
You agree not to use the service for: unlawful content, malware, copyright-infringing files, child sexual abuse material, threats, harassment or unauthorized data collection. A page may ask for identity documents or documents that carry a social security or tax ID number (such as a W-2, a 1099 or a tax return) only if the person uploading them knows who is asking and why, has agreed to send them, and you have a lawful reason to receive them - for example, a client sending their own tax documents to their accountant. Collecting such documents under a false pretext, in someone else's name or without the person's consent, and asking for payment card details, is never allowed. You are responsible for handling the documents you receive in line with the law that applies to you. The operator may suspend or delete content without notice if a violation is suspected.
Every uploaded file is automatically scanned with ClamAV. Files flagged as possible malware are not deleted: they are delivered to the recipient with a "possible virus" warning. We may open a flagged file only to check whether the warning was correct; we do not review file content for any other purpose. Scanning is automated and best-effort, not a guarantee: no scanner detects every threat, and a file larger than the scanner can read is recorded as not scanned rather than clean. Opening a flagged file is at the recipient's own risk.
4. Your content
You retain ownership of any content you upload. By uploading you grant the operator a worldwide, royalty-free license to host and serve that content for the duration of its retention period. You are responsible for ensuring your content does not violate any law or third-party right.
5. Account and termination
You may delete your account or any request at any time. The operator may suspend or terminate access for violations and may discontinue the service at any time.
6. Limitation of liability
To the maximum extent permitted by law, the operator shall not be liable for indirect, incidental, special, consequential damages or loss of data, profits or goodwill. Total liability shall not exceed €10. Mandatory provisions (intent, gross negligence, product liability) remain unaffected.
Files on an upload page are uploaded by other people. We do not create, choose or read them and are not responsible for their content, legality or safety. To the extent the law allows, we are not liable for damage caused by a file uploaded to or downloaded from the service, including malware a scan did not catch - you open downloaded files at your own risk.
7. Changes
Material changes will be announced on the site. Continued use constitutes acceptance.
8. Governing law
These terms are governed by the laws of the Socialist Republic of Vietnam. For consumers resident in the European Union, mandatory provisions of consumer law in their country of residence remain unaffected.
